1) Acceptance of Terms
By submitting the Executive Stress Audit (“ESA”) form, scheduling any session, or interacting with our services, you (“you,” “client,” or “user”) agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not submit the form or use our services.
2) Nature of Services (Educational & Non-Medical)
The ESA provides education, stress-management insights, and lifestyle guidance only.
The ESA is not medical advice, diagnosis, treatment, or a substitute for licensed healthcare.
Any bodywork services offered by Eustress AVL are non-medical, within North Carolina scope, and intended for general stress relief and relaxation.
We do not claim to treat, cure, prevent, or diagnose any condition. Always consult your physician or qualified provider regarding health concerns.
3) Eligibility & Client Responsibilities
You must be 18+ (or have written guardian consent).
You agree to provide truthful, complete information on forms (ESA, intake, consent).
You agree to update us about any health changes that could affect your participation.
You are responsible for consulting your healthcare provider before following any suggestion.
4) No Guarantees; Individual Results Vary
Your outcomes depend on many factors (history, lifestyle, adherence, etc.). We make no guarantee of specific results, relief, or timeframes.
5) Scheduling, Cancellations, No-Shows (if applicable)
Scheduling is handled via Acuity Scheduling (or our current scheduler).
You agree to the posted cancellation/no-show policy shown at booking.
If a fee applies (e.g., missed appointment, late cancellation), you authorize the card on file to be charged.
We may reschedule or cancel at our discretion (e.g., practitioner illness, safety, weather).
6) Fees & Payments (for paid services)
ESA may be offered at no charge; if a price applies, it will be displayed prior to submission.
For paid services (e.g., sessions, memberships), prices are shown at checkout and are subject to change.
You authorize us (and our processors, e.g., Square) to charge applicable amounts, taxes, and authorized fees.
All sales are final unless our written policy states otherwise.
7) Communications Consent (Email/SMS)
By submitting the ESA, you consent to receive operational messages (e.g., confirmations, reminders, post-session summaries) and occasional educational or promotional messages from Eustress AVL via email and/or SMS. Message/data rates may apply. You can opt out anytime (email unsubscribe link or reply STOP for SMS), though doing so may limit service reminders.
8) Post-Session Overviews & Educational Content
Post-session summaries, check-ins, and suggestions are for education only.
Implementing any suggestion is your decision and responsibility.
If discomfort or adverse effects arise, stop and consult a healthcare provider.
9) Health & Safety Acknowledgment
You acknowledge:
You may be asked to complete an intake/consent.
You will inform us of pain, discomfort, boundaries, or health changes immediately.
Services may be declined, modified, or terminated for safety, scope, or ethical reasons.
10) Professional Boundaries & Conduct
We maintain strict professional boundaries (draping, informed consent, privacy, safety). We reserve the right to refuse or terminate services for inappropriate behavior, safety concerns, or policy violations.
11) Privacy & Data Handling
We collect the data you provide (ESA responses, intake, contact info) to deliver services and improve quality.
We may use third-party tools (e.g., Jotform, Zapier, Klaviyo, Acuity, Google Workspace, Square) to process/store data under their own terms.
We implement reasonable safeguards but cannot guarantee absolute security.
We do not sell your personal information. See our Privacy Policy for details and your choices.
12) Testimonials, Reviews & Media
With your explicit consent, we may use anonymized feedback, ratings, or testimonials for marketing and education.
You may withdraw consent for future use by contacting us (does not affect materials already published in reliance on prior consent).
13) Intellectual Property
All ESA materials, PDFs, stage frameworks, brand assets, and content are owned by Eustress AVL or licensed to us. You receive a limited, non-transferable license for personal use. You may not copy, distribute, or create derivative works without written permission.
14) Third-Party Links & Tools
We are not responsible for third-party websites or tools. Use them at your discretion and per their policies.
15) Disclaimer of Warranties
To the fullest extent permitted by law, services and content are provided “as is” and “as available” without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.
16) Limitation of Liability
To the fullest extent permitted by law, Eustress AVL (including owners, contractors, employees) will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the ESA or services. Our total liability for any claim will not exceed the amount you paid (if any) for the service giving rise to the claim.
17) Indemnification
You agree to indemnify, defend, and hold harmless Eustress AVL from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the ESA or services; (b) violation of these Terms; or (c) negligence, misconduct, or violation of law.
18) Compliance; No Referral Compensation
We comply with applicable North Carolina laws and professional scope. We do not provide or accept illegal referral fees, kickbacks, or similar prohibited compensation.
19) Non-Discrimination & Accessibility
We do not discriminate based on race, color, religion, sex, sexual orientation, gender identity/expression, national origin, age, disability, or any protected status. Reasonable accommodation requests may be made by contacting us in advance.
20) Termination & Refusal of Service
We may suspend or terminate access to services at any time for safety, scope, policy, or legal reasons. You may discontinue participation at any time; any refunds (if applicable) will follow our written policy.
21) Changes to Terms
We may update these Terms from time to time. Changes take effect upon posting the revised Effective Date. Continued use after changes means you accept the updated Terms.
22) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Good-Faith Resolution: You agree to first attempt to resolve disputes informally with us.
Arbitration: If unresolved within 30 days, disputes will be resolved by binding arbitration in Buncombe County, NC under the rules of the American Arbitration Association.
No Class Actions: You and we waive the right to participate in class or representative actions.
Injunctive Relief: Either party may seek temporary injunctive relief in court to protect confidential information or IP pending arbitration.
If any provision is found unenforceable, the remaining provisions remain in effect.
23) Entire Agreement
These Terms, together with any posted policies (e.g., Privacy Policy, cancellation terms), constitute the entire agreement between you and Eustress AVL regarding the ESA and related services.
Electronic Consent & Signature
By checking the box and submitting the ESA form, you acknowledge that you have read, understood, and agree to these Terms & Conditions and to receive communications electronically. You affirm that your electronic agreement constitutes your signature and acceptance.
